                                                 RELEASE AND INDEMNIFICATION

Event:

I, the undersigned, wish to voluntarily participate in The Great Outdoors Unlimited outdoor ministry events and activities.  I, fully recognizing the dangers and hazards inherent in the activity, including personal injury, property damage, or wrongful death, as well as result of the unknown dangers and hazards which may arise from the use of borrowed equipment, including but not limited to firearms in the course of my participation in the activity. I have read and do agree with the release and indemnification outlined below. The undersigned is hereby granted permission to participate in The Great Outdoors Unlimited outdoor ministry events and related activities conducted by or on behalf of The Great Outdoors Unlimited and/or by the Released Parties (as defined below) for the date signed by the participant.  For and in consideration of the Released Parties granting the undersigned use of necessary equipment provided on loan by The Great Outdoors Unlimited (the Property) for these events and permitting me to participate in such activities associated with hunting, camping or fishing, including but not limited to the use of firearms, bows, cutting tools, fire building, and or boats, the undersigned does hereby release, relinquish, and discharge and agree to indemnify and hold harmless The Great Outdoors Unlimited, and their respective officers, directors, members, managers, servants, agents, volunteers, contractors and employees (collectively, the “Released Parties”) of and from any and all claims, demands, liabilities, suits, causes of action, obligations, damages, injuries, losses, penalties, costs, charges, and expenses (including, without limitation, attorney’s fees, court costs, consultant fees, expert fees, and other litigation-related expenses) of whatsoever kind or character directly or indirectly resulting from, arising out of or in connection with, or relating to (1) any condition of the Property; (2) any use or occupation of the Property, including for hunting or fishing  and related activities; (3) any act of negligence, whether of omission or commission, of the undersigned, or any of their agents, servants, employees, contractors, subcontractors, or any other person acting on behalf of the undersigned; (4) any damage to the undersigned’s property which may arise in connection with the foregoing; (5) any accident, injury, or damage whatsoever caused to any person, firm, corporation, or property. This release and indemnification extends to and includes any and all claims for bodily injury, death, sickness, disease, property damage or destruction, consequential damage, or economic loss caused to or suffered by any person or property, including, but not limited to the undersigned, and any agents, servants, employees, contractors, subcontractors, or any other person acting on behalf of the undersigned, or any other person or entity. In case of any action or proceeding brought against the Released Parties by reason of any such claim the undersigned, upon notice from the Released Parties, agrees to defend the action or proceedings by counsel acceptable to the Released Parties at the undersigned’s cost.  THE PROVISIONS OF THIS RELEASE AND INDEMNIFICATION SHALL REMAIN AND BE IN FULL FORCE AND EFFECT EVEN IF ANY CLAIM, DEMAND, LOSS, LIABILITY, DAMAGE, OR EXPENSE, OR CLAIM THEREFOR, BY ANY PERSON OR ENTITY, DIRECTLY OR INDIRECTLY RESULTS FROM, ARISES OUT OF, OR RELATES TO, OR IS ASSERTED TO HAVE RESULTED FROM, ARISEN OUT OF, OR BE RELATED TO, IN WHOLE OR IN PART, ONE OR MORE NEGLIGENT ACTS OR OMISSIONS OF ANY RELEASED PARTY, OR ANY OF THE RELEASED PARTIES’ RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, AGENTS, SERVANTS, EMPLOYEES, VOLUNTEERS, CONTRACTORS OR ANY OTHER PERSON OR ENTITY ACTING ON BEHALF OF THE RELEASED PARTIES, THE PARTIES INTENDING HEREBY TO SATISFY THE EXPRESS NEGLIGENCE DOCTRINE. Furthermore, I the undersigned to hereby agree to replace or make restitution for any damage inflicted or incurred on equipment loaned or provided by The Great Outdoors Unlimited. Note: All parties agree that affixing electronic signature and returning by electronic mail from the recipient’s email address shall constitute a legal and binding signature by recipient.
